Boost! Cockpit End-User Access Agreement

Effective Date: June 17, 2026

1. Agreement to Terms

This End-User Access Agreement ("Agreement") governs your access to and use of Boost! Cockpit's software, website, and related services (collectively, the "Software"). By accessing or using the Software, you agree to be bound by this Agreement.

2. License Grant

Subject to your compliance with this Agreement, Boost! Cockpit grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Software for your internal business or personal purposes, as applicable.

3. Restrictions

You may not, and may not permit others to:

  • Copy, modify, translate, or create derivative works of the Software except as expressly permitted.
  • Reverse engineer, decompile, disassemble, or attempt to discover source code or underlying algorithms.
  • Rent, lease, sell, sublicense, or distribute the Software.
  • Use the Software for unlawful, fraudulent, harmful, or abusive purposes.
  • Interfere with or disrupt the Software, servers, or security features.
  • Upload malicious code or attempt unauthorized access to accounts or systems.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us promptly of any unauthorized access or suspected security breach.

5. Intellectual Property

The Software and all related content, features, design elements, trademarks, and technology are owned by Boost! Cockpit or its licensors and are protected by intellectual property laws. Except for the limited license granted in this Agreement, no rights are transferred to you.

6. User Content

If you upload, submit, or create content through the Software, you retain ownership of your content, subject to any rights you grant us that are necessary to provide the Service. You represent that you have the rights needed to submit such content and that it does not violate any law or third-party rights.

7. Third-Party Services

The Software may integrate with or rely on third-party services. We are not responsible for third-party products, services, content, or policies, and your use of those services may be subject to separate terms.

8. Suspension and Termination

We may suspend or terminate your access to the Software immediately if we believe you have violated this Agreement, created risk, or used the Software in an unauthorized manner. Upon termination, your right to use the Software ends immediately.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOST! COCKPIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOST! COCKPIT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SOFTWARE OR THIS AGREEMENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless Boost! Cockpit from claims, damages, liabilities, losses, and expenses arising from your use of the Software, your content, or your violation of this Agreement or applicable law.

12. Changes to the Agreement

We may update this Agreement from time to time. Continued use of the Software after changes become effective constitutes acceptance of the updated Agreement.

13. Governing Law

This Agreement is governed by the laws of the State of Georgia, without regard to conflict-of-law principles, unless applicable law requires otherwise.
